The United States has announced a new visa restriction policy targeting foreign nationals responsible for, or complicit in, South African laws and policies involving uncompensated land seizures, race- based discrimination and the incitement of imminent violence against minority ethnic or racial groups.
Secretary of State Marco Rubio announced the policy in a press statement, citing Section 212(a)(3)(C) of the U.S. Immigration and Nationality Act.
The provision allows the secretary of state to deem a foreign national inadmissible when their entry into the United States could have “potentially serious adverse foreign policy consequences” for the country.
The statement said certain family members may also be covered by the restrictions.
The announcement follows President Donald Trump’s Executive Order 14204, titled “Addressing Egregious Actions of the Republic of South Africa.”
According to the State Department, the United States remains concerned about what it characterizes as racially
motivated crime and government- sponsored discrimination against Afrikaners and other minority populations in South Africa.
The administration specifically pointed to race-based legislation, threats to expropriate land without compensation and what it described as dehumanizing chants and slogans that could contribute to racial violence.
Rubio said the South African government had not adequately addressed concerns previously raised by Washington.
“The United States will not allow such behavior to go unchecked,” Rubio said, arguing that the actions at issue undermine peace, economic stability and the rule of law and are.incompatible with U.S. foreign-policy priorities.
The policy is expected to operate through targeted visa restrictions rather than a blanket suspension of travel or a general ban on South African nationals.
The statement did not identify specific individuals, provide a list of affected officials or explain when the restrictions would take effect. It also did not outline the process for designations, appeals or removals from the restricted list.
The announcement represents a further escalation in Washington’s pressure on Pretoria. US urged the South African govt to respond quickly to what it called “egregious actions,” but the statement did not detail any immediate diplomatic or economic measures beyond the visa policy.
At the center of the dispute is South Africa’s approach to land reform and property rights. The U.S. statement described possible land expropriation without compensation as a threat to minority communities and economic stability.
South African authorities and supporters of land reform have historically framed the issue within the country’s broader effort to address effects of colonialism and apartheid, including highly unequal land ownership.
The State Department statement, however, focused on the potential impact of expropriation policies on Afrikaners and other minority groups.
The policy also places emphasis on alleged incitement of imminent violence. Under the authority cited by the State Department, visa restrictions can be imposed on foreign nationals whose presence in the United States is judged to carry serious foreign-policy
consequences, even where the announcement does not allege criminal charges or announce sanctions against a government as a whole.
The statement did not say whether the United States had consulted South African officials before announcing the restrictions, nor did it specify whether the measures would affect current visa holders, future applicants or both.
It likewise did not state how many people might be affected. For now, the announcement signals that the United States intends to use immigration
restrictions to pressure South Africa over racial discrimination, land policy and rhetoric that Washington believes could lead to violence.
The effectiveness of the measure will depend on how broadly the administration applies it and how Pretoria responds.
